This policy governs the exercise of the right of withdrawal, the return of products purchased through the Bazar La Minervetta website, and the handling of any products that may be defective, damaged or non-conforming.

The provisions relating to the right of withdrawal apply exclusively to Customers who make a purchase as consumers, i.e. for purposes unrelated to their business, commercial, craft or professional activity, in accordance with Italian Legislative Decree No. 206/2005 (Consumer Code).

Right of withdrawal

Consumer Customers have the right to withdraw from the purchase contract, without having to provide any reason, within 14 days from the day on which the Customer, or a third party other than the carrier and designated by the Customer, acquires physical possession of the products.

In the case of a single order relating to multiple products delivered separately, the period shall run from the day on which the Customer, or a third party designated by the Customer other than the carrier, acquires physical possession of the last product.

The right of withdrawal applies to distance purchases made through the website and does not apply to purchases concluded directly at the physical store, unless more favourable commercial conditions are voluntarily granted by the Seller.

How to exercise the right of withdrawal and request a return

Once the intention to exercise the right of withdrawal has been communicated, the products must be returned within the following 14 days, as provided for by Article 57 of the Consumer Code.

2.Choose the type of request (withdrawal, return or damaged item), select the products and state the reason.

4.The products must be shipped within 14 days from the communication of withdrawal, carefully packaged and in compliance with the conditions set out on this page.

Return shipping costs shall be borne by the Customer, unless otherwise agreed or unless specific promotions expressly provide for different conditions.

Instructions following the withdrawal request

Once the withdrawal notice has been received, Bazar La Minervetta may contact the Customer to provide the operational instructions necessary for returning the product.

Given the particular nature of certain items sold, the return arrangements may be specified taking into account the characteristics of the individual product, such as size, weight, fragility and value.

In particular, for ceramic and glass items, design objects and other fragile, bulky or particularly valuable products, Bazar La Minervetta may provide specific instructions regarding packaging and the most appropriate methods for carrying out the return safely.

For such products, the Customer is therefore advised to wait for the Seller's operational instructions before proceeding with shipment.

These instructions are intended solely to facilitate the proper and safe return of the product and do not constitute authorisation to exercise the right of withdrawal, nor may they limit its effectiveness or the time limits provided by law.

Fragile, bulky or particularly valuable products

Given the particular nature of certain products sold by Bazar La Minervetta, including large vases and objects, ceramics, glassware, design accessories and fragile, bulky or particularly valuable items, their return may require specific packaging and transport methods.

Where the right of withdrawal is exercised due to a simple change of mind, the direct costs of returning the goods shall remain the responsibility of the Customer.

For such products, following the communication of withdrawal, Bazar La Minervetta may contact the Customer and provide operational instructions regarding the packaging and return methods considered most appropriate in view of the product's characteristics, size, weight, fragility and value.

The Customer is advised to wait for these instructions before proceeding with shipment, in order to reduce the risk of damage during transport.

Returning bulky, fragile or high-value products may involve transport costs significantly higher than those of ordinary postal shipment. Such direct costs shall remain the responsibility of the Customer within the limits provided by the applicable legislation.

The instructions provided by the Seller are solely operational in nature and do not constitute authorisation for withdrawal or limit the exercise of the rights granted to consumers by law.

Return deadline

Following the communication of withdrawal, the Customer must return the products without undue delay and in any event within 14 days from the date on which the Customer communicated the decision to withdraw.

The deadline is met if the Customer ships the products before the 14-day period expires.

Any communications between Bazar La Minervetta and the Customer concerning the operational arrangements for the return shall not affect the time limits established by law for exercising the right of withdrawal and returning the products.

Return costs

The direct costs of returning the products shall be borne by the Customer, except where otherwise provided by law.

The Customer is therefore responsible for paying the costs necessary to return the product to the Seller.

Given the nature of certain products sold, particularly fragile or high-value items, it may be advisable to use a trackable shipping service and, where necessary, one suitable for the value and characteristics of the product.

It is understood that, in the event of a defective, damaged or non-conforming product, the provisions governing the Legal Guarantee of Conformity shall apply and the related costs may not be charged to the consumer in the cases provided by law.

Condition of returned products and diminished value

Upon receipt of the returned product, Bazar La Minervetta will check its condition, taking into account the nature and characteristics of the item.

The Customer is responsible for any diminished value of the product resulting from handling other than that necessary to establish its nature, characteristics and functioning, in accordance with the applicable legislation.

By way of example, a return may be considered non-compliant if the product:

shows damage, breakage, scratches, stains, alterations or clear signs of use that cannot be attributed to the normal inspection of the goods;

has been used beyond what is reasonably necessary to establish its nature, characteristics and functioning;

is returned without all parts, components or accessories originally supplied;

in the case of clothing or textile products, shows signs of use, washing, stains, odours or alterations;

is missing items, certificates, tags, labels or accessories whose absence causes an actual reduction in the value of the product;

shows damage attributable to packaging that is clearly inadequate in relation to the nature, size and fragility of the item during return shipment.

If, following inspection, a reduction in value is found to be attributable to handling of the product beyond what is necessary to establish its nature, characteristics and functioning, Bazar La Minervetta may take this into account when determining the amount to be refunded, within the limits permitted by the applicable legislation.

In the event of significant irregularities, Bazar La Minervetta may document the condition of the product received, including by means of photographs, and notify the Customer, stating the reasons for any reduction in value found.

For ceramic and glass products, design objects, large vases and other fragile, bulky or particularly valuable items, the Customer is advised to follow with particular care any operational instructions provided by the Seller for packaging and return, in order to reduce the risk of damage during transport.

These rules do not apply where the product was originally delivered to the Customer damaged, defective or non-conforming; in such cases, the provisions relating to the Legal Guarantee of Conformity shall apply.

Handcrafted products and characteristics inherent in craftsmanship

Some products sold by Bazar La Minervetta are handcrafted and may therefore display characteristics inherent in manual workmanship.

Minor variations in colour, shade, shape, decoration, finish or size compared with the images shown on the website may constitute natural and distinctive characteristics of handcrafted production.

Where such variations are compatible with the nature of the product and the declared craftsmanship and do not impair the essential characteristics or use of the goods, they do not in themselves constitute a lack of conformity.

In any event, the consumer's right to the Legal Guarantee of Conformity remains unaffected where the product has an actual lack of conformity under the applicable legislation.

Made-to-order or personalised products

In the cases provided for by Article 59 of the Consumer Code, the right of withdrawal is excluded for the supply of goods made to the consumer's specifications or clearly personalised, produced on the basis of individual specifications requested by the Customer.

The exclusion of the right of withdrawal does not affect the Customer's rights in the event of a defective or non-conforming product.

Refund

Where the right of withdrawal is validly exercised, Bazar La Minervetta will refund the Customer the price paid for the returned products and the costs incurred for the original delivery, limited to the cost of the least expensive standard delivery method offered by the Seller.

Any supplementary costs resulting from the Customer's choice of a delivery method other than and more expensive than the least expensive standard delivery method available will not be refunded.

The direct costs incurred by the Customer to return the products to Bazar La Minervetta shall remain entirely the responsibility of the Customer.

The refund will be made without undue delay and in any event within 14 days from the date on which Bazar La Minervetta was informed of the Customer's decision to withdraw. However, Bazar La Minervetta may withhold the refund until it has received the products or until the Customer has provided evidence that they have been shipped, whichever occurs first.

The refund will be made using the same means of payment used for the initial transaction, unless otherwise agreed with the Customer and provided that the Customer does not incur any costs as a result of the refund.

Any liability of the Customer for diminished value of the product in the cases and within the limits provided by the applicable legislation remains unaffected.

Products damaged during transport

Upon delivery, the Customer is advised to check the external condition of the package.

If the package shows clear signs of damage, crushing, opening or tampering, it is recommended, where possible, to accept the delivery subject to reservation, indicating to the carrier the nature of the damage found.

If a product is received broken or damaged, the Customer is advised to contact Bazar La Minervetta promptly, providing, where possible:

order number;

description of the problem;

photographs of the damaged product;

photographs of the outer packaging;

photographs of the inner packaging and protective materials;

any documentation relating to the delivery.

Prompt notification and photographic documentation facilitate verification of the incident and handling of the claim with the carrier, without affecting the consumer's mandatory rights under the law.

Defective or non-conforming products

The right of withdrawal is distinct from the Legal Guarantee of Conformity.

If the product received has a lack of conformity, the consumer Customer benefits from the protections provided for by Articles 128 et seq. of the Consumer Code.

The Customer is advised to contact Bazar La Minervetta, describing the problem found and, where possible, attaching photographs that allow for an initial assessment.

The costs necessary for the application of the remedies provided under the Legal Guarantee of Conformity shall not be borne by the consumer in the cases provided by law.

The characteristics and natural variations inherent in handcrafted products, where consistent with the description and nature of the goods purchased, do not automatically constitute a lack of conformity.

Difference between withdrawal and a non-conforming product

In the event of a simple change of mind regarding a conforming product, the provisions relating to the right of withdrawal shall apply and the direct costs of return shall be borne by the Customer.

If, on the other hand, the product is actually defective, damaged or non-conforming, the provisions relating to the Legal Guarantee of Conformity and the other protections provided by the applicable legislation shall apply.

Exchanges

Unless otherwise stated or as part of a specific commercial initiative, Bazar La Minervetta does not offer direct exchanges for products purchased online.

If the Customer wishes to purchase a different product, variant, size or item, the Customer may exercise the right of withdrawal in respect of the product originally purchased, where applicable, and place a new order.
